I. Detailed implementation rules for a series of the Shanghai Technology Innovation Center’s exit-entry policies

(I) Provisions on overseas talent recognition standards

1. Foreign talents recognized in the market-based mode

Adjustment linked up with the wage and tax is made in light of the multiple of Shanghai’s per capita wage and tax standard for the previous year. This year’s standard for foreigners employed in Shanghai is more than 600,000 yuan of annual wage income and more than 120,000 yuan of individual income tax paid in the year.

2. Foreign talents and special talents from Hong Kong and Macao recognized by departments in charge of talents

Relevant competent departments such as the Organization Department of the CPC Central Committee, the Ministry of Human Resources and Social Security and the State Administration of Foreign Experts Affairs recognize and issue certificates to foreign talents and special talents from Hong Kong and Macao, or the Organization Department of the CPC Shanghai Municipal Committee, the Shanghai Municipal Human Resources and Social Security Bureau and the Shanghai Administration of Foreign Experts Affairs recognize and issue certificates to foreign talents and special talents from Hong Kong and Macao (not subject to the age limit of 60).

3. Foreign talents and special talents from Hong Kong and Macao employed and vouched for by enterprises on the technology innovation “occupation list”

The Shanghai Municipal Talent Work Leading Group and the department in charge of technology innovation recognize senior industrial professional talents employed and vouched for by entities on the Shanghai technology innovation occupation list (not subject to the age limit of 60).

(II) Provisions on application for permanent residence by overseas talents

1. Foreign talents recognized in the market-based mode may apply for permanent residence upon recommendation by their entities if their annual wage income and individual income tax paid in the year reach the prescribed standards and they have worked in Shanghai for four consecutive years and lived in China for no less than six months cumulatively. Foreign applicants who fail to reach the prescribed standard of individual income tax paid in the year due to their enterprises’ tax planning but meet all other conditions may also apply for foreigners’ permanent residence after enterprises’ payment of tax in arrears reaches the standard and applicants’ payment of individual income tax in the year reaches the standard.

2. Foreign talents recognized by departments in charge of talents with talent recognition certificates may apply for work-type residence permits with the note “talent” valid for five years. After having worked for three years, they may directly apply for permanent residence upon recommendation by their entities, and meanwhile the period of examination and approval will be shortened from 180 days to 90 days.

3. Senior industrial professional talents employed and vouched for by entities on the technology innovation “occupation list” with enterprises’ employment contracts and vouching certificates may apply for work-type residence permits with the note “talent” valid for five years. After having worked for three years, they may directly apply for permanent residence upon recommendation by their vouching entities, and meanwhile the period of examination and approval will be shortened from 180 days to 90 days.

(III) Provision on application for R (talent) visas by foreign talents

Where foreign talents come to China with no visa, they may apply for R (talent) visas to the visa authority of Shanghai’s port and enter with recognition certificates of departments in charge of talents or vouching certificates of enterprises on the technology innovation “occupation list”; where they come to China with other visas and have the above talent recognition certificates or vouching certificates, they may apply for changing their visas into R (talent) visas at the department of the Shanghai Public Security Bureau in charge of exit-entry administration.

(IV) Provision on application for residence permits by foreign students engaging in innovation and entrepreneurship in Shanghai

Foreign students with diplomas of domestic institutions of higher learning and innovation and entrepreneurship plans or enterprise founding certificates may apply for residence permits for private affairs with the note “entrepreneurship” valid for two years to carry out post-graduation internship, innovation and entrepreneurship activities. If they are employed by relevant entities in this period, they may apply for work-type residence permits according to the provisions.

(V) Provision on simplification of entry and residence formalities for foreigners employed in Shanghai

Foreigners overseas may apply for work visas to the visa authority of Shanghai’s port and enter with employment licenses. Foreigners in Shanghai with employment licenses may apply for work-type residence permits for less than one year to the department of the public security organ in charge of exit-entry administration first and then finish the corresponding employment formalities such as application for alien employment permits, foreign expert work permits, etc.

(VI) Provision on application for visas and residence permits by foreigners who come to Shanghai for investment, innovation or entrepreneurship

Where foreigners who plan to come to Shanghai for investment, innovation or entrepreneurship do not have enough time to apply for employment licenses, they may apply for private matter visas to the visa authority of Shanghai’s port with investment certificates or entrepreneurship plans, livelihood certificates, etc. After entry, they may apply for residence permits for private affairs with the note “entrepreneurship” to the department of the Shanghai Public Security Bureau in charge of exit-entry administration with corresponding certificates.

(VII) Provision on expansion of the scope of application for long-term residence permits

If foreigners working in Shanghai have applied for work-type residence permits for two consecutive times and abided by Chinese laws and regulations, they may directly apply for work-type residence permits valid for five years the third time.

(VIII) Provision on expansion of the scope of application for exit-entry certificates by non-permanent residents of Shanghai

Permanent residents of other provinces and municipalities living in Shanghai may apply for various exit-entry certificates with Shanghai residence cards and second-generation identity cards (except those who will emigrate to Hong Kong and Macao). Submission of other certificates and verification of social security payment are no longer required.

(IX) Provision on application for emigration to Shanghai by special talents from Hong Kong and Macao and their relatives

Implementation Measures for Emigration of Special Talents from Hong Kong and Macao and Their Relatives to Shanghai were promulgated and implemented. Applicants who meet the conditions may seek information and handle formalities in the reception hall of the Exit-Entry Administration Bureau of the Shanghai Public Security Bureau.

(X) Provision on employment of foreign household service workers by foreign high-level talents

Foreign talents who meet the recognition standards may apply for residence permits for private affairs for foreign household service workers employed by them after obtaining permanent residence status or work-type residence permits. Each family may employ one foreign household service worker. At the time of application, the household service worker needs to provide the employment contract as well as financial security, personal insurance and health certificates.

II. Supporting measures for a series of the Shanghai Technology Innovation Center’s exit-entry policies

(I) The exit-entry reception halls of all public security organs in the city offer various acceptance services for foreigners including services for foreigners’ permanent residence to serve various technology innovation parks’ development.

The exit-entry reception halls of all district (county) public security sub-bureaus in the city and the Free Trade Zone Sub-Bureau have added special windows for application for certificates by technology innovation talents including services for foreigners’ permanent residence and long-term residence permits. In the year, the exit-entry reception halls in the city will add the plate of “Exit-Entry Certificate Issuance Service Point of ×× District for the Zhangjiang National Innovation Demonstration Zone” to provide more convenient services.

(II) Further promoting the self-help Hong Kong and Macao endorsement issuance service

Shanghai’s residents may use the “electronic self-help Hong Kong and Macao endorsement machines” in 21 exit-entry reception halls of public security organs including the exit-entry reception halls of the headquarters of the Exit-Entry Administration Bureau at 1500 Minsheng Road, the Free Trade Zone Sub-Bureau and all district (county) public security sub-bureaus to apply for Hong Kong and Macao endorsement quickly. Among them, the exit-entry reception hall of the Xuhui Sub-Bureau offers the self-help Hong Kong and Macao endorsement issuance service around the clock. Meanwhile, extension of this service to the Changning Road Police Station of the Zhabei Sub-Bureau for the first time was tried out to reach the last mile of services for the people and realize a higher level of certificate issuance nearby.

(III) Improving the “port visa online pre-application service”

Various port visa online pre-application service functions including invitation by entities and invitation by individuals were launched to facilitate pre-application for the corresponding port visas for foreigners by inviters in Shanghai via the Online Platform for Government Affairs of Exit-Entry Administration Bureau of Shanghai Public Security Bureau.

(IV) Expanding electronic certificate issuance support service functions

“Self-help public government affairs information inquiry machines” were provided in all exit-entry reception halls in the city to make the government’s new policy measures public and known by more people; “self-help certificate issuance flow guide machines” were provided to offer customized services to the groups benefited by the new policies and allow the Technology Innovation Center’s talents to enjoy better certificate issuance experience; the “multimedia support service system for certificate issuance at windows” was provided to accept supervision and improve the service level actively.

(V) Facilitating the people with more information and serving the development trend of “Internet + police affairs”

The Exit-Entry Administration Bureau of the Shanghai Public Security Bureau opened second-generation WeChat service functions. The first one is WeChat message pushing: notice and reminder messages are pushed to applicants at various points of certificate issuance to allow applicants to timely know application progress; the second one is the customized reply function: after an applicant sends a request on the WeChat page, WeChat will give the applicant a timely reply to provide the relevant information; the third one is certificate issuance flow guidance: applicants may inquire about the certificate issuance flow through WeChat; the fourth one is navigation for acceptance locations: introduction of the map navigation function helps applicants locate and find exit-entry reception halls and facilitates applicants’ certificate application nearby. Chinese citizens can realize quick acceptance and shorten the period of certificate collection by making online appointments and WeChat appointments. By the end of the year, the goal of increasing the proportion of online appointments to the total number of exit-entry certificate applications to 50% will be realized.

(VI) Trying out the “online and WeChat payment” function for certificate issuance services

In the year, the new function of online payment with UnionPay cards will be gradually promoted to realize quick and convenient payment.

(VII) Establishing additional service stations for overseas personnel at places where the Technology Innovation Center’s talents gather

On the basis of the existing 33 service stations for overseas personnel in the city, 13 service stations for overseas personnel will be added to provide the Technology Innovation Center’s talents with services such as publicity about a series of the Shanghai Technology Innovation Center’s exit-entry policies, consulting and pre-acceptance of visa applications.
